I live in Oregon and I was a victim of a sexual assault and there were no witnesses! I filed a restraining order against the person but he contested it and a hearing was scheduled. I did not show up to the hearing because I was deathly afraid of facing him in person. Because I did not appear, the restraining order was dismissed. My new employer is running a background check. Is the restraining order that I filed for going to show up??

I don't think this depends on the state that you live in. Whether filing for such an order would show up more likely depends on the level of the background check. If it does, I don't think that it would create a problem. If you are asked about it, you tell them just what you said here.

Well the restraining order was NOT filed against YOU-- so I can't imagine it would show up.
If it did-- the only thing that I know my own employer would like to know are the details about who the restraining order is against so security can know and be on the look out to ensure you do not face harassment while at work.
I had an employee this happened to once and security just wanted information so they could ensure she always had an escort outside the building to her car and on the way into work i.e. they want to make sure you are kept safe as well as the other employees.

The company/ coworkers know the employee and in most cases would of course take extra precaution for their safety in regards to escorting them out to their car.
It's a little different when someone is brand new and issues like this come up. When you start a new job you kind of have to be "problem free" for at least a few months.

Criminal background checks do not name the victim, only the criminal. Furthermore, most states have laws protecting the victims of violence. Even if the restraining order was dropped, it is most likely illegal for an employer to punish you for being a victim. You may want to contact these people for more information: Oregon Department of Justice Crime Victims' Services Division. Even if the restraining order was dropped, you have rights.

The restraining order was never granted. The only way this would show up is if they went looking for every lawsuit or legal action a person had FILED.
