My friend learned at work today that everyone in his office of 50 staff members will be ''interviewed'' by HR and a Corporate rep next week to determine who goes, who stays. They all were given a list of questions to study to prepare. They were told that half of them will be going with a severance package. Also that seniority or past performance will have nothing to do with the outcomes. It will all be based on these ''interviews''.
Have any of you heard of such a thing?
Is this legal?

Never heard of such a thing. In CA, everyone is employed "at will", which means that someone can be "fired" at any time, for any reason.

I've heard of it. As long as all have a shot, it is legal. At will means they can wave bye-bye to all 50 if they wish.

It is often done with relos. The Met Life Northeastern folks must interview to get the same jobs (often at less pay) in most cases, and there are far fewer jobs available than affected employees.

All your friend needs to do in order to succeed is to come up with a plan to have the fractional pennies from interest calculations deposited to his personal bank account.

Funny you mention that, I was thinking that the ideas was taken from that same money with the whole interviews. Rather than HR, they had outsiders come in and give suggestions based on interviews on who would get cut.

That's a goofy way to figure out who gets laid off. I wonder if this company has had EEOC complaints before regarding layoffs or is dealing with the perception that their layoff practices have an adverse impact against a protected group, and so they're doing these interviews so that there's a paper trail by "impartial" people in HR and Corporate instead of relying on performance reviews by managers.

Actually, that's still goofy because typically people know who is too valuable to lose and who can go depending on their job function.

The only time I've seen this is with a re-org or merger situation. I've been on both sides of that (interviewer and interviewee), not a particularly fun way to spend a couple weeks, but better than random selections I guess.

It's perfectly legal.

Yup, happened to me in 2005. And after the interviews were done some were kept and the other ones wasn't and that's when it seemed like the down spiral started during my working life.

1999 to 2005, employed consistently without any layoffs

2005 to 2011, laid off 4 times

Reminds me of the scene in "American beauty" where Kevin Spacey was being interviewed by the hatchet man about who is expendable. Past work performance says a lot but they are basing it on one interview. Not right from an ethical standpoint but legal unfortunately.Sucks people who have worked hard, Spent years doing it and made sacrifices with their own time might get the short end of the stick. : (

That stinks, I guess all you can do is walk in there and show what your job is, what you do, and how you are valuable to the company.

Hopefully it's not just some ruse to get rid of the non-popular people.

Walk in their CHARMING and BUBBLY if you have to. Have Chapstick and kneepads!
