A background check CANNOT be done without your consent. It is illegal. They musy provide you with a disclosure and authorization form or they are not supposed to do it. Read up on the FCRA. An employer also does not have to wait until a job offer is made to do a background check. Many employers do them on every applicant to ensure that there are no discrimination issues.

Uh...it sort of depends as to what you agree to when you sign documents so technically as long as you sign it implies concent.
Vermont I think is the only state that requires a separate line item for it specifically.

Let's say you have a verizon cell phone (or any company). If you don't pay the bill it lapses into collections. Collections then runs a background check on you (credit check). You agreed to the terms and conditions of the contract so therefore it acts like an agreement as part of terms of service.
