Hey all, I have a house in Kekaha I lived in for five years, been renting it out for three, no problems until now. This tenant hasn't paid a dime in rent for two months. I gave a 10 day notice to remedy, no remedy. Wondering what's next from my perspective as I'm off island? Is this something I need to hire a lawyer to file suit to evict for? or, something I can do over the phone, or on my own? Should my on island contact ( a neighbor who helps out ) have to get involved? Never been through this situation before, any guidance is appreciated...

Do you pay any taxes for this rental property that you lived in for 5 years? This sounds like an agreement between 4 of you. 3 of them opted out of the agreement. Are you the property owner to this house? If no, then that agreement is between you and the 3 others. You are also liable. You cannot kick anybody out because you don't own the property, as you have lived in it for only five years.

Or did someone gave you the property as an inheritance? Then you may still need to pay an inheritance tax. And renting it out. In the event that you must move out, you must find some other 3 renters to meet that part of the agreement. Then you can remain there. Otherwise the owner will kick you out with the three others. We all want to be the person who owns it. Because we can charge $750 dollars per month for rental. Considering Kekaha, I'd say that is a fair price. But with no jobs around the area, who can afford that rent but military people or an engineer only staying there for about a year or two then moving away. The average pay guy cannot afford this. So you will find no one else to rent it to. This is the problem. No demand in sight.

Did you go to small claims court? If yes, what did the judge say? I was wondering what the damages was and to whom it went to. What was the decision? My guess is no facts to be found. And you are relieved of this agreement. But what does that mean now? For the owners who are balking? So...the 4 of you sort speaking, stole the owners house in Kekaha, Kaua'i. Is that correct?
