Know any good lawyers in Maryville?
Does anyone know of any good lawyers in the Maryville area? My boyfriend is being sued by a collection agency and it is hard to find anyone that handles this kind of stuff. It is for a fairly large amount of money and he literally cannot afford a screw up!
Any help is appreciated!! Thank you

Good luck finding a lawyer who will take his case. Collection agencies want the money, and sueing is one way of them getting it. Odds are if you go to court, a judge will rule against you and order the money deducted from his paycheck. His best bet is to pay his debt, even if its a little bit each week.

It's a long story and there is no way he can pay what they want.
I don't really thing it's fair for him to have to pay a debt that has been sold 3 times and was the result of fraud to begin with. It started at $3000 and is now close to $20,000....no contact for the past 5 years and suddenly a lawsuit. Everything they have done is completely illegal, but I don't really feel comfortable arguing this is court. If we could find a lawyer versed in fair credit laws, I'd feel better about going to court. But the only ones I've found are in Nashville and Morristown....I guess bankruptcy is the only other option at this point...No way we're going to let them garnish his checks...We are barely scraping by as it is.

If the debt originated in Tennessee, the statute of limitations is six years, which may be why they are now trying to collect. If the debt was incurred somewhere else, their time may have already run out.

How is the debt "illegal"? Did you know your boyfriend or see him sign the papers? If he hasn't paid on a $3,000 debt in many years it will balloon. Accounts are sold to different collection agnecies all the time and that has no bearing on the validity of the underlying debt. I'm not sure if a lawyer could win that case, collections is cut and dry usually, perhaps the attorney could negotiate the debt. If your boyfriend has a lump sum to offer them, I would have him do so, all the lawyer can do is say no. If an agreement is reached, get it IN WRITING, signed by the attorney or other authorized representative.

Check out creditboards.com and look for "WhyChat". This man knows his "stuff" on legal issues and I personally used his advice and walked away from a 9K debt that was sold 4 times etc. I paid 0 without the expense of an atty. Good Luck!
