I've done the week to week thing before and it's always a hassle. The tenant just needs to move out and find a smaller/cheaper place to live. No other way around it.

Begin the eviction process immediately. Things will not get better. Also do not take a partial payment no matter how enticing it is as you will never see the rest. Follow all the time frames and evict them as soon as the law allows. It is easier the first time to have a company do the process like the eviction king or the eviction queen ie: NMI. Do a full eviction, follow through and do the lockout. Don't take any shortcuts either follow the law perfectly. You will be required to store their items for 30days and send them a letter that you will be disposing of their things per the code.

In the future, write up a contract and follow it to the letter. Ie: rent is due on the first and delinquent after the 5th. Then send them the 5 day pay or quit soon thereafter. If you are consistent they cannot complain especially if you are up front with them to begin with.

Another thing, don't let them slide on 1st month, security deposit, and any other deposits before they move in. If they can't come up with them before they move in don't rent to them. If you let them move in and wait a month to come up with the security deposit, you won't see it. Believe me.
Also pay the money and do a background check on them. This includes evictions in any other state.

Put in language that forbids sub leasing and list every person who is going to be at the rental.

Check on your property regularly and write a clause that specifically addresses that to check for leaks, routine maintenance ect..
