I have a condo at the Meridian and signed up with an independent property manager.

According to my friends and family, the norm is that the property manager shows the landlord any potential tenant application. However, my property manager claims she never does that as that information is confidential. She only tells me a "Summary" of her findings about any potential tenants.

Is it because she is pulling a scam on me or is it because she is afraid I would steal her tenant and not pay her commission? Is this common? Thanks!

How is the information confidential? If you were doing the leg work, you would be getting the exact same information.

I'm not saying that your property manager is doing something fishy, but it seems like you have just started using this person to manage your property. I say let them go and find someone else.

Remember to talk about and agree to the process they use to find tenants, collect pay, carry out routine maintenance and write it all down. Also, I hope your not paying them while your property is empty, a common clause is that the property must be occupied for the property manager to get paid.

olecapt is correct, so it is time to pull the plug on her. I almost think that her Summary is a figment of her imagination put on paper for your enjoyment.

Inappropriate behavior. My property manager has been very open and informative of the tenants, and I will always have the final decision. He also manages a number of Meridian units. Contact me if you want his name.

The application is between the manager and the applicant. A lease is between the management and the tenant (and those do get sent to an owner). However, passing along someone's completed application containing their SSN, bank account #'s etc is a clear violation of their privacy. (I've had owners ask for the applicant's credit report, too!) The owner has hired the manager to screen tenants, and that's what they're licensed to do. If you want all that info, do it yourself.

Agreed. I pay my property manager for a service. Part of that service is to screen applicants. If I can't trust my PM to provide that service in a competent manner then I shouldn't be doing business with him.

Not normally in Nevada. The GLVAR application which is normally used is between the LL and Agent and the prospective tenant.

In NV it appears the property manager is a fiduciary agent of the LL. Thus I don't believe there can be any legitimate witholding of info from the LL unless it is agreeable to the LL.

One can of course leave all that to the PM...but the PM has no independent right to act free of the LL.

I suppose you could establish such a relationship in the PM agreement. But I would think it would also be revocable by the LL. And then the PM would have to turn over the file.
