@shadow - Hard to understand exactly what you're saying. Is this tenant still in the property but hasn't paid?

Take a big breath. If he leaves without being evicted, fine. He doesn't get his deposit back immediately. You have 30 days to look everything over and make the necessary deductions to his deposit for unpaid rent, damages, etc. If he owes more than the amount of the deposit, consider whether suing him for the balance makes sense, considering the time and expense involved, and the likelihood of recovery.

Being a landlord has never held any appeal to me. When I left Minneapolis in 1996 I had a condo-loft in a building with 32 units and half were in foreclosure, and I couldn't find a realtor to list my property, so I rented it for a year, banked the rent money and let it go into foreclosure. Had no interest in being an absentee landlord 1600 miles away, or even 1 mile away.

Just the idea of it, some tenant waking me out of a deep sleep in summer telling me the A/C isn't working!

One of my neighbor's ex-wives went ballistic a month ago, crashed her car through the garage door of his townhouse and pushed his Mustang right through the retaining wall of the courtyard, and not finished, she smashed windows in his house.
