Recently I witnessed an assault and was wondering why it was allowed to occur.
The incident took place in the early morning hours at The Orleans. A young man who was clearly intoxicated (by every definition) was ordering drinks 2-at-a-time while causing a commotion at a BJ table. The waitress, dealer and floor person were absolutely oblivious. I observed the situation because I knew it was only a matter of time before things "jump off". It only took @2 minutes actually...

Here's how it went down:

Drunk guy begins verbally abusing other patrons at the table
Patrons requests intervention (floor person)
Floor person does nothing
Waitress brings 2 more drinks as drunk guy had spilled the others (on the table)
Patrons ask why drunk guy is still being served alcohol
Drunk guy takes offense and knocks over chair
Patrons request security
Floor person comes to table and again does nothing
Patrons cash out and as they are leaving drunk guy takes a swing (misses)
Drunk guy then proceeds to order 2 more drinks
FINALLY, floor person asks drunk guy to leave
Drunk guy staggers away...

WTF?

For this to happen on a casino floor, and nothing done about it should be an embarrassment to the casino, and to the whole Boyd gaming company as a whole.

This is re-enforcement, to the fact that, you are no longer safe in a casino, or their property
and that you should keep this in mind at all times.

Jonathan

PS: Event, if you would have videotaped this (OK, I know I'm old using that term) The casino would have detained YOU
for "violating their rules"

California Law:

If a customer shows signs of obvious intoxication such as staggering throughout the bar, has breath that smells like alcohol, has dilated pupils of the eyes, has a slurred speech and/or has poor muscular coordination, the bartender legally has to cut that person off from purchasing any more alcohol. If a bartender is caught serving an obviously intoxicated person, the bartender could be guilty of a misdemeanor

Isn't it also possible that if the very drunk person leaves and drives and gets into an accident the bartender/bar could also be in trouble for that?

I was referring to the California law stated, as it seems similar to my state.

Most states have a "dram shop" law of some sort imposing liability on establishments that serve alcohol to intoxicated persons. Nevada is one of a very few states that has no such law.

I have a friend who was a cocktail waitress "back in the day."

We talked about this kind of scenario once. She told me that "back in the day" she would have squirted a couple drops of Visine into the drunk's drink. He'd be hurling and sh**ing himself in the bathroom within minutes.

We both agreed that's pretty nasty. But that's how it was dealt with "back in the day."
