Hi all!

I was thinking of buying a property mainly as my family's vacation house.
I'm hoping to also rent it out by day/week the rest of the time we're not using it.

I've inquired and one of the realtors told me that they need to check with the city (Summerlin Area) first, as I may get fined if I rent it out like that.

I see properties offering their houses for rent on sites like homeaway all the time... how can they do that?

They can't. They do it anyway and hope not to get caught.

Make sure you buy someplace that isn't gated if you're going this route. But there's no way in hell I'd ever rent short-term to vacationers. Long-term tenants can be bad enough. I wouldn't want to take my chances on 100 people each year -- it only takes one vandal/criminal/pig to make your life miserable.

Besides, what are you going to do, come out to Las Vegas every time a guest leaves to reset the property? There are sheets to clean, toilet paper to restock, and inevitable cleaning up after guests. It's either that or hire a maid every time. Either way, no thanks. WAY too many people in and out of the property for my comfort level.

Does the "Party House Ordinance" cover the entire valley, or is it just particular neighborhoods? -- I gotta read up on this...

I'm sure one of the local realtors can answer if there's any place where short-term rentals are allowed. I'm not aware of any in the valley. Think about it -- do you think the resorts want people to have options?

Keep in mind, I use sites like homeaway when I go on vacation. I PREFER to vacation this way. But not because I'm a party animal. Because I want access to a kitchen while on vacation. Buying great local stuff and cooking it is one of the things I enjoy most about vacationing.

I know damned well that most of the houses I rent this way are in neighborhoods where this is not allowed. So I am a super-conscientious guest -- both to the neighbors, and to the homeowner I'm renting from. If the neighbors ask who I am, I'll reply, "I'm Mary's uncle Jack from Key West. I'm visiting for a few days. Mary's out shopping. Nice neighborhood!"

That keeps homeowner Mary out of trouble. But a lot of people wouldn't think to do that. "Hi! We're renting this house from Mary for the weekend. We found it on homeaway!" Mary now has problems with her HOA, code enforcement, and whoever else has an interest in preventing Mary from renting her house short term.

Covers all neighborhoods. Enforcement is very variable. It depends on whether you annoy the neighbors or not.

So if you buy a place on its own two acres you are unlikely to have a problem. If however you buy a home in a regular tract and a couple of neighbors get annoyed and call code enforcement you will likely end up with a problem.

Some neighborhoods appear to ignore it. But they don't have to.

The case in the newspaper was a limit one. The guy had made a deal to sin no more...then sinned more.

Yup, Scoop... that's the main reason why I'm even thinking about this.
When my family (parents and siblings with their own little families) flew in from out of the country, we couldn't all fit in my house, so we rented one in Henderson.

It's super nice, because we were able to be together in one house versus different rooms (possibly different floors) in a hotel. We bought supplies from the store and prepared our own meals. We basically had our own little buffet, without spending as much money.

They got to exerience local lifestyle for a week, and we were also close enough to GVR for the usual casino stuff.

I guess I'll just have to find a house with no neighbors huh.

I see this is a Clark County bylaw. Do all incorporated areas in greater Las Vegas (ie Henderson) have similar ordinances? Seems very big brotherish to me.
