No, I'm pretty sure they're fruit flies, bugbully, they match photos I've seen on the internet.
I've had them a few times before, over the years, only in the summer. More annoying than anything else.
I just looked at some website from the University of Kentucky...
construct a trap by placing a paper funnel (rolled from a sheet of notebook paper) into a jar which is then baited with a few ounces of cider vinegar. Place the jar trap(s) wherever fruit flies are seen. This simple but effective trap will soon catch any remaining adult flies which can then be killed or released outdoors.
I'm going to try it, I've got nothing to lose
Except a few fruit flies...

Just checking, I usually get a lot of calls for gnats. When you buy plants and planting soil, most of the time the eggs from the gnats are in there and they hatch, and then you have a mess.

Also, you can see them around the sinks, attracted to the junk that get build up in the pipes. Tonight before you go to sleep, try putting a cup or two of bleach down the drains and cover over night.

Ummm, I read that somewhere just before, but Sheriff said he tried that and it didn't work.
So long as I keep the fruit in the fridge, I have no problem. But I know they must be around the house, you take that fruit basket out and put it on the counter for just a couple of minutes and they come around. It's annoying because banana's don't keep in the fridge, and I like fruit that is room temp, not icy cold...
I regularly put bleach down my drain and disposal...to keep them clean, I really don't think they are coming from there. They're hiding in the house somewhere...

I was having a problem a few weeks ago, I sought advise on here as well, but as soon as they appeared they vanished. I must of had 100s in my apartment. I never found the source, but I still think it had something to do with the filthy lady upstairs.
I did many things, so I'm not sure what the trick was that got rid of them. I bleached every inch of my kitchen, bathroom, etc... I also moved all of my plants outside for a while. I thought maybe I had an infestation in one of my houseplants. My cat was having a great time going after them, but there were just too many for her to kill.
I have read mixed reviews about hanging the bags of water, though some people swear that it works.

no clorox does not kill them weird I know!
Try this It Works!
Make a cone out of the sheet of paper (like a funnel).
Check that the cone fits snugly into a glass or cup.
Cut off the tip of the cone so that you now have a funnel.
Pour a small amount of cider vinegar into the glass or jar.
Set it by the sink and watch em enter and cannot escape. Ha ha ha
