Do hoa's really care?
Hi everyone,
I bought my house a couple months ago. It was a bank owned property but we had looked at quite a few and this particular house was in the best condition. We live off of gibson and galleria. Theres a whole cluster of Lennar homes. The house is only four years old and we got a good deal on it. The problem is we have a shared driveway with our next door neighbor. Theres no separation between the two properties. So we've been there two months and our neighbors or the most part are pretty quiet. Well that changed two weeks ago. My wife and I cant understand what has happened but all these kids have moved into the house. Seems like the parents that were there have left. There teenage daughter has stayed behind but I dont think she lives there anymore either. One day all this furniture showed up in the driveway. Then by the afternoon there garage had all the furniture in it. Then we noticed people were actually living in the garage. Theres a minimum five teenagers at the house. There always moving around the property, they dont sit still very long. They play music until the morning and they talk loud and basically dont care about anything. They've lit firecrackers in the driveway. They skateboard and do stunts even right next to my suv. My wife told me the other night there was a group of teens out front with a bag over there mouth. And theres other teens that come over quite often. Its like people coming in and out of there place. They also speed through the community. One of them almost hit me. They ran a stop sign and I had to slam my brakes on. It pissed me of cuz I had my kids with me. So I emailed my hoa and they told me to email them all my complaints and they will send the home owner a violation letter. Thats fine but what if they dont stop what can or will the hoa do if anything? My wife and I are really upset about this whole situation because we bought this house so now we're stuck here. I just hope these people dont stay much longer but theres no way to know.

Read your R&Rs for the HOA. Find every rule they are violating and request a violation notice for each. Attend your regular HOA meetings and make sure appropriate fines are being levied by the HOA.

Ever think of getting the Police involved? I'm sure they have underage drinking, drugs and maybe outstanding warrants. Next time something happends, call the police and complain of noise and unlawfull assembly. I'm sure if the will find something. I had a bad neighbor in California and the lady next to him always called the cops and his guy ended up going to jail for some stupid reason.

I'll all but duplicate jpk's advice, attend those HOA meeting which is very, very, very important, good chance to network with other residents there.
I attend all of my association meetings. Perhchance they are renters and to rent in our complex, the owner's must fill out an application along with an application fee for screening purposes.
My heart goes out to you! Noise is the number 1 reason people relocate!

For a situation like that, you have to keep sending complaints to the HOA board for all the rules they are violating. Keep at it. If they get 3 of the same type of complaints, the owner will be called to a violation hearing. Then it depends on what they say if anything gets done. If it continues, keep doing it.
And if you can't get anywhere with that, try neighborhood mediation. Contact the Justice center downtown and arrange a mediation if all else fails from the HOA. You as the owners would meet with the owners of the house next door in a neutral location with mediators. It's all free.
Also, like some have said above, call the police. Especially for the music that goes on all night. Also, check with your HOA to see if living in a garage is against the rules. Most times it is. (depending on your HOA)Good luck.

YOur complaint is above the grade level of the HOA. They do lousey at refereeing social things.
IN most cases you will get more relief from the municipality than from the HOA.
The HOA has no mechanism to deal with your kind of complaint. They really can't police the place. They can enforce the HOA rules...But they seldom read on where skate boards can be ridden...particularly when a right of way or similar is involved.
So call the cops...and write the HOA when you can make it stick. But it is likely the cops or the town that will help your case most.
A mess of unruly teenagers generally does not violate the CC&Rs.
