Hi,

We traveled to US last summer for our vacation and my B2 M visa will expire by mid of 2014, now my husband and my three years daughter are a US Citizen, right now we are living in middle east. My husband's job contract will expire soon and we are planing to move to US in June 2013 to start our life there. here is my question:-

May I travel with my B2 visa and after that to change it to AOS or let my husband to go there and file me the i-130 form and me staying my home country with my baby waiting for I-130 immigration paper work?

Which one is the better way to get my green card?

It is visa fraud to use your tourist visa with the intent of immigrating to the USA, don;t do it. Your husband can petition for you now. You can visit on your tourist visa, but cannot stay in the USA until your immigrant visa (IR-1) is approved.

Dear Penguin_ie, Thank you for your quick advice. I really appreciate. What we should do know? let my husband file the I-130 form or what? where i get the IR-1 visa? may i apply at the embassy here?

Your husband sends in a petition (starting with the I-130 and bio documents, marriage cert etc) to the Chicago Lockbox. Once that is approved, you can apply for a visa. You will have your interview at the local US embassy and a medical with an embassy approved doctor.
