I am getting a divorce. I am a US citizen. My wife is not a US citizen, but a perm. resident with no conditions.She wants to go back to her home country, and leave her 6 year old child, also a perm. resident, but not US citizen with friends here in the US. I am the step father, but have no legal right to him, since I have not adopted him. She got full custody from the birth father due to abuse. He lives in her home country.
She feels she can not take care of him, and thinks he would do much better here with these friends here. Can she willingly gives custody to these friends?
We have contacted 2 different attorneys, and both said you need to contact someone else? What kind of attorney would handle this? Who's laws would be involved? Here or the home country??
Anyone ever seen a situation like this? Would like some help!
Your ex-wife seems reasonable. Any parent who would be willing to keep their child in another country for the child's well-being sounds exceptional in character to me! So, why don't you and her sit down together and discuss you adopting the child? She should keep the child with someone who has been an influence, even if for a little while.
