Also, DACA (Deferred Action for Childhood Arrivals) does not confer legal status.
Quote:
If my case is deferred, am I in lawful status for the period of deferral?
No. Although action on your case has been deferred and you do not accrue unlawful presence during the period of deferred action, deferred action does not confer any lawful status.
A disaster for legal residents and their children trying to find a job or get into college. I'm sure these dreamers will line up for all the welfare, Pell Grants, etc.... It is so wrong to reward law breakers and punish people that follow the law, work hard, pay taxes and try to live good honest lives.
Even more insane is that millions of AMERICAN CITIZENS are unemployed, losing their homes and living under bridges with their children. It's long past time for a moratorium on ALL immigration, so that we can take care of our own first. Once our economy stabilizes then I am all for LEGAL immigration to resume if said immigrant has a needed skill. Illegals simply need to get the hell out and take their dreams and their tax draining anchor babies with them.
And all the illegals have to do is make a few claims -- true or false ones on some form and they're given a nice work visa and legal status. There will be no verification made on the claims they make, if they arrived last year, nothing stops them from checking the box that they were here before a certain date.
These 2 million visas are being given out on the honor system -- to illegals.
Deferred action is a discretionary determination to defer removal action of an individual as an act of prosecutorial discretion.
Deferred action does not confer lawful status upon an individual.
In addition, although an individual whose case is deferred will not be considered to be accruing unlawful presence in the United States during the period deferred action is in effect, deferred action does not excuse individuals of any previous or subsequent periods of unlawful presence.
Under existing regulations, an individual whose case has been deferred is eligible to receive employment authorization for the period of deferred action, provided he or she can demonstrate “an economic necessity for employment.”
DHS can terminate or renew deferred action at any time at the agency’s discretion.
Quote:
Does deferred action provide me with a path to permanent residence status or citizenship?
No.
Deferred action is a form of prosecutorial discretion that does not confer lawful permanent resident status or a path to citizenship.
Only the Congress, acting through its legislative authority, can confer these rights.
