My wife and kids recently went to India and attended for H4 visa, she got query. Don't know what are they going to ask.
Here is my situation: Currently, I am holding H1 visa which is valid from Jun 6th 13 to April 26th or so. Before H1 approval I had F1 visa with OPT from some XXX university which does't have an accreditation. The reason I went that route is my 6 yrs was maxed out last year 27th Jul, 12 and my LC was in Audit and applied in 6th year so I can't get the 1 yr extension also. So I had to COS to F1 with that university and they provided CPT meaning I have started working since then. What my employer did was he didn't run my payroll for Jun and Jul 2012 to recapture the time for my H1 visa when we apply for H1 extension after 1yr completion of my LC. My LC is still in pending status that is different story. Now I have got 1 yr approval and my family went to India for visiting.
With all these being said, now they might ask about H1 to F1 COS and viceversa. Could someone help on this situation like is there danger for H4 visa? Please help me guys. I appreciate your help!
Your H-1B visa is sponsored thru some Desi Consultancy? You should have tried Canada for visa stamping. so many people who went to India for stamping never came back because of reputation of Desi Consultancy.
Your wife and kids had I-20 from that unaccredited University? Like Tri-Valley or UNVA?
How long is your Green Card wait?
I don't think they would question an H-4 dependent about your H and F history, necessarily. It may be that they simply need current proof you are still working in H-1B status (via letter from employer or most recent paystub). U.S. consular sections in India are scrutinizing H visas very closely. Of course, if your H-1B petitioner employer has a bad reputation or is a willful violator or H-1B dependent, this may also be an issue.
