Have you actually gone to and read through the USCIS website? Before you go looking for an immigration attorney you can find out what you need to know about the NIW right here and see for yourself how and if you qualify:

I hope everything works out here for you. We desperately need more people here in California. There is no competition for jobs, no competition for housing and there is no traffic. Bring all of your extended family too!

I wish you the best, but there are certain things about your post I don't understand. Firstly, you say you are an EB-1 which actually is divided into 3 subcategories- these would be extraordinary ability (EB1-1), or multinational manager/executive (EB1-3) or outstanding researcher/professor (EB1-2).

Then you said you could also be an EB-2 (advanced degree or exceptional ability), which can include National Interest Waiver (NIW) petitions.

A NIW petition will require some form of letter or evidence that proves your skills and presence in the U.S. are in the best interest of the U.S. This is easier said than done - if you work on delicate matters for a government agency, then you are more likely to get such evidence, but the work must really be specialized. For instance, I worked on a NIW I-140 petition for a data mining person who worked on DOD projects. Obviously, his expertise was very narrow and rare at the time (early 1990s), so that was an easy NIW case.

Generally speaking, though, whether you are an EB-2 or EB-3 is not necessarily based on your degrees. In fact, the job you would be doing in the U.S. and wehther it requires a degree at all would be used to determine whether you'd fall in EB-2 or EB-3, regardless of how many degrees you have.

For instance, I had a client who insisted she was an EB-2 because of her two master's degrees. However, the work she did for her employer was akin to a translator/interpreter and escort for VIPs. This kind of job does not require any degree at all. Neither the employer nor its competitors and industry at large require any minimum education beyond high school and thus this lady is now in the EB-3 queue, despite her inflated sense of self.

Generally, unless you are in one of the EB-1 categories or an EB-2 NIW, you will need to have a petitioner/employer or petitioner/agent to file the I-140. EB-2 and EB-3 workers are required to go through the PERM labor certification step prior to the filing of the I-140 petition.

For many U.S.-based employers, hiring someone from abroad is very expensive and - unless there are unique skills or abilities - very unnecessary, especially with high unemployment and the influx of recent college graduates entering the job market.

The business environment in the U.S. is very different than the business environment in Europe (note: I am European). Even 'small' things like CVs and resumes are different. European CVs include a lot of personal information that in the U.S. is unnecessary for legal reasons. For example, in the U.S. it is not ok to ask if someone has children, is married, etc. Often many HR professionals reject these types of CVs not because of the immigration implications, but because of the very personal details that are included.

The other issue is that most foreigners see the U.S. as basically Los Angeles and New York. Yes, California is nice and New York is awesome, but there are plenty of other parts of the U.S. that may offer a chance to live in the U.S. - sure, they may lack the glamour, but they may be another avenue to search for jobs. You can always find a new employer when you're already in the U.S.

What he said was, "I'm ... maybe eligible for EB1A but it is not a strong case ..." At this point he has no immigration visa.

Finding a big American woman to marry and mistreat you would be your best bet (if you are a man, of course), if you've been to USA for long enough you should know what makes an American woman (of all sizes and colors) tick. I've seen all kinds of (West and East) Europeans married to Americans, unfortunately, I don't know that many Western Europeans who secured legal status using other means, unless they got here in 1950s. If you are an "upwardly mobile" material ... there is just that special woman who's looking for you , if not, it would be practically impossible unless you'll hit working class bbws.

The finest couple I've seen was a rotten toothed Texas redneck in his 30s who hooked up with a trashy looking British woman in her 50s (over internet to boot). Surprisingly their marriage lasted for 4 years at the time I've met them. Love works in very mysterious ways.

Dear cheapcharly,

We know from all your threads and posts that obtaining permanent resident status (green card) and coming to the USA just hasn't worked out for you. We know that you really don't like it here, we know you've decided to leave the US and turn in your green card and, overall, know just how much this whole thing has upset you.

But please, cheapcharly, just hand in your green card and leave and stop bashing everything about the USA. Go find the place which doesn't have ugly fat women, where there's a better life, ladies and money and where you won't go nuts staying here any longer. Just go, charly. Bon voyage!

No, not a Xerox. I believe the brand name is "CopyBucks" and you can purchase them at WalMart, KMart and other similar outlets as well as online via Amazon. The machine itself is very reasonably priced but the special paper and ink are pricey. See how much more there is to learn about living in America?

You must be kidding. What part of California are you talking about? I live in the southern part and we sure don't need more people here, jobs are scarce, housing prices are on the rise and investors are buying everything up and there are traffic jams on our freeways every day including weekends. Yeah sure thing, bring the extended family to.
