Btw you might want to follow the Rockefeller court case which is broadcast live on court tv on a daily base. The woman was married to a German man, but she didn't know that. He claimed that he couldn't travel because of air sickness, couldn't drive a car because his vision was bad....and because of that she never thought anything wrong about him not showing her a passport or drivers license. He controlled the bank accounts since she worked, she didn't know any passwords and only because he kidnapped their daughter after she left, she found out she was married to a person with a complete different id....so don't buy the passport story, it could be 50% true, but also 50% untrue...you wouldn't be the first who found out that their hubby was not the one they thought he would be....

How long does it takes to process the whole petition thing while the son of the us citizen is in the united states with a b2 visa?the son is already 28 but not yet married. The real question is how long will it take before the whole process ends?thank you so much for the reply, will be much appreciated.

It doesn't matter whether the son is in the US or not.
Unmarried adult son of US Citizen currently takes between 7 and 19 years, depending on what country he's from.

Thank you for the reply so it doesn't matter if the son is in the us or not. Coz like i saw the procedures the son has to get home to his country while the process is ongoing. I appreciate the reply you have been very helpful. God bless!

Because he's over 21 he has to leave and wait for his green card which takes years. He can't stay in the meantime and if he does stay illegally he can't get the green card. In his immigration category he can't adjust status in the US. If he stays here illegally for over a year he will have to leave and serve out a ten year bar on re-entry before he can qualify for a green card. So please don't consider having him stay after the B2 visa expires. A lot of people foolishly do this and end up paying a high price later.

The son may be able to get another kind of non-immigrant visa so that he can live here at least part of the time while he's waiting for his priority date to become current. He may be able to get a student visa or a work visa. That's the only way he could be in the country legally before he gets his green card.

i am u.s. citizen - petition sister and her 2 small children to visit in the u.s. as tourist visa , but she wants to file a divorce while she's here in the u.s. Is it possible - could the children go to school?

Not while she is here on a visitor vsa. Some schools will accept students with respective visa and tuition.

She can probably get a divorce- in states like Nevada, it takes only 6 weeks. But that doesn't mean she can stay here. If you petition her for a sibling visa to get a greencard, you are looking at a 10+ year waitinglist. If she comes on a tourist visa, she needs to qualify by herself, you cannot petition her, and she cannot stay past what the immigration officer at the border gives her, usually 6 months. If the kids want to go to school they would need an F1 student visa, tourist visas are for visiting/ vacation, not going to school.
