According to Fcc regulations every 3 years a television station should decide if it wants to invoke "must carry" or "transmission consent required status" with a local cable company.

On Sept 27, 2011 WFMZ Allentown sent out 53 letters to cable companies in the Philadelphia DMZ area saying that they elect "must carry" status. In exchange for "must carry" status, they are not allowed to ask for re-transmission fees.

WCAU or NBC Philadelphia channel 10 (NBC owned and operated) sends out hundreds of letters stating retransmission consent required. As such, they are free to negotiate a retransmission fee.

Univision WUVP-DT VINELAND, NJ Channel 65 has also elected for retransmission consent status.

A database is not provided, but it looks like the majority of commercial TV stations elect to require retransmission consent, and negotiate a fee with the cable companies.

WTVE-TV (Reading) only posts letters to DIRECTV, DISH, and Comcast saying they have elected "must carry" status. It is not clear what the status is with other cable networks.

It does appear that individual cable companies are now free to exclude cable stations that are doubles. It is not so much federal regulation as it is business practices.

This fight to Keep CBS on Time Warner Cable was supposed to be resolved this week. It seems like it's still ongoing.

It seems like the system is breaking down. For example CBS has 5 of the 6 most popular 30 minute situation comedies on TV still producing live broadcasts. The top 4 are produced by Chuck Lorre
BIG BANG THEORY - Chuck Lorre sho
TWO & A HALF MEN - Chuck Lorre
2 BROKE GIRLS - Chuck Lorre
MIKE & MOLLY - Chuck Lorre
HOW I MET YOUR MOTHER - one more season, and then series ends

The only sitcom on the other networks with comparable ratings to these 5 shows is Modern Family on ABC.

So you can almost imagine the Chuck Lorre channel on the web, where people will pay $1 to watch a couple new episode of each comedy.
So now CBS is not a "must carry" station. So they are rapidly increasing their retransmission fees. But all their programs can be viewed from the CBS website after they air on live TV.

But Aereo will debut in Philadelphia any month now. For $8/month you will be able to look at all OTA stations and have a 20 hour DVR service available. A $35 dongle will permit you to easily throw your signal from tablet, computer, or smartphone onto your TV screen.
