In response to Stephanieuk- you are not allowed to live your life however you see fit, if you negatively impact those around you. The neighbor my be an old jerk, but it is pretty inconsiderate to wake people up early in the morning with barking dogs. Instead of always thinking about yourself folks might want to think about how their actions affect everyone around them.

Did she not agree to stop letting them outside before he awoke? and she also agreed not to let them out after he went to bed at 9:00?

I think that is MORE than ok....

Some people just complain to have a life....sounds like this person might fit the bill. Also, they have owned the house for 50 years...maybe they should have sold his girlfriends house if it was that big of a deal.

We had neighbors with barking dogs. They'd bark until midnight, maybe 1. Ok for the owners as they were up late but I went to bed at 9 and and was up at 4. Finally I started taking my coffee out on the deck at 4:15, which set them off. I think the neighbors got the hint.

We did have one guy who got the police and animal control due to a barking dog issue. After a year of it and a LOT of hard feelings the people gave their dogs away. Within a week the complainer bought a dog, which is either barking or sleeping. Luckily I moved before too long.

Local Ordinances
For further information on laws that pertain to animals, please visit the Lexington-Fayette Urban County Government’s website(Chapter 4 of LFUCG Code of Ordinances)

Dog & Cat Licenses Section 4-12.3
All dogs and cats must be licensed annually starting at 6 months of age and rabies vaccinated at 4 months of age.

Leash Law Section 4-19
All dogs in Fayette County must be on a leash, behind a fence, or on the dog owner’s property under the owner’s supervision at all times when outside. Dogs cannot run-at-large, even under voice command, and they must wear their current license and rabies tags at all times. If you receive a summons or citation because your dog was running loose or not wearing its license/rabies tags, the fines can be paid at the Fayette County District Court.

There are three locations in Fayette County where dogs can run off-leash in designated areas: Masterson Station Park, Jacobson Park, and Coldstream Park.

Barking Dogs Section 14/72 (10)

If you are having a problem with a barking dog, please consider the following options:

<!--[if !supportLists]-->1.) <!--[endif]-->Talk to your neighbor – Please give your neighbor the benefit of the doubt. In many situations, someone with a noisy dog may not realize that there is a disturbance. Dogs bark because of numerous reasons including loneliness, boredom, other animals, passersby, or because they’re being teased. Doing someone a favor by informing them of the situation first could be the neighborly thing to do!

<!--[if !supportLists]-->2.) <!--[endif]-->Put it in writing – If after talking to your neighbor the problem continues, write a letter reminding him/her of the situation. Try not to use a threatening tone and explain that if the problem doesn’t get better you will need to contact local authorities. Maintain a list of the occasions you’ve spoken to the neighbor about the problem. Be sure to record the dates, times, and durations of barking.

<!--[if !supportLists]-->3.) <!--[endif]-->Enforcement possibilities – Note: Continual dog barking is a misdemeanor violation that must be witnessed for enforcement to go forward. If you have witnessed a violation, it will probably be necessary for you to appear in court.
  • <!--[endif]-->Call the Lexington Police Department (258-3600) for advice to see what assistance is available.
  • <!--[endif]-->Call Lexington-Fayette Animal Care & Control (255-9033) to make an official complaint. Have the address of the violation and the name of the pet owner (if possible). As a first step, LFACC may leave a warning at the address regarding the disturbance. If the violation is not witnessed by an officer, to move forward it would be necessary for you to file a complaint with the County Attorney’s Office.
  • <!--[endif]-->Call the County Attorney’s Office (254-4941) to directly file an official complaint. Be prepared to report your contact information, whether you’ve spoken to your neighbor about the problem, and how often and many times the disturbance has occurred.
<!--[if !supportLists]-->4.) <!--[endif]-->Mediation** – It’s always best if neighbors can work together. Voluntary mediation can be a valuable tool in helping parties arrive at an acceptable, peaceful solution. Mediation must be agreed upon by both involved parties. Call the not-for-profit Mediation Center of Kentucky (859-246-2664) to request a session with a professional mediator. There is a fee for the service that is split between both parties. If you mention this website, a reduced rate could apply.
**Voluntary involvement

Pooper Scooper Section 4-23.1
The Pooper Scooper ordinance is handled by the Lexington Police Department.

Stray Dogs & Cats Section 4-21
All impounded stray dogs are held for a minimum of 5 days and cats for a minimum of 3 days with the hope that their owners will reclaim them.

Kennel Permit Section 4-12.4
If you own 8 or more dogs or puppies, you need to apply for an annual kennel license through Lexington-Fayette Animal Care & Control.

<!--[if !supportLists]--> · <!--[endif]-->Additionally, each dog and/or puppy must be individually licensed and current on its rabies vaccinations.

Citations
If you were issued a citation for any local ordinance violation, please contact the district court to remit payment.

He put up a privacy fence which was good , he has had his attorney write us letters, he has put up a box that was suppose to make high pitched sounds to make them not bark ( they now run straight to the tree where he had it and bark ) He has also gotten on the dog comminttee here in Lex, ( how that happen he doesnt even have a dog )he also says that my husbands Harley wakes him of the morning when he starts it for work and wants that to stop as well, ....Ever time our dogs bark we either go out and make them stop or we bring them in. They are dogs okay and dogs bark, they bark at the wind, the birds, people passing on the street walking, but its just a bark its not like they do it for long periods of time, we do not allow that. but they do bark,,and when other dogs around the area bark so do they, This neighbor has told them that our dogs make the entire neighbor hood start barking all the time..This is not true, I am at my witts ends. I have done ever thing that I possible know to do with out getting rid of my dogs...BUt that isnt going to happen..
So I guess what I am asking is WHAT CAN I DO...I need help....Can anyone please give me a suggestion or a solution to this rididioucs neighbor....
