Brookhaven fence setback (live, zoning, law)

Does anyone know the actual fence setback required between neighbors? An adversarial one of mine just told me he is putting one in between our yards this week, and he built his pool about 5 feet from the property line, (while we were away) so there is certainly not 6 feet there, as I thought was required. Thanks!

To the best of my knowledge, a fence can be built on/along the rear and side property lines. It would appear that you need to know what the setback is for the neighbor's pool or any pool.

Searching Brookhaven Town Code:
SS 85-370

No outdoor swimming pool shall be situated in the required front yard. No outdoor swimming pool shall be located less than 15 feet from any side or rear lot line. With respect to aboveground swimming pools, said distance shall be measured from the outer edge of any deck or platform attached to the wall of the pool.

State law is actually 4 ft. fence for a pool.

Most towns require a permit for pools and location. You need to check to see if he had a permit to build esp. if it is inground.

You can take him to the town Zoning Board of Appeals and force him to move the pool. It has been done where I live.
