Hello, how can I check whether an upstairs apartment in a two-family house in Nassau County is legal? Is there a department within New York State or Nassau County that I can call to verify this? Please let me know. Thank you!

You need to call the building department in the town where the home is located.

quick way to check is to check mynassauproperty and see if there is any indication of a 2-family house or something.

the apt I just moved into 2 months ago has a note like that.

also a bunch of tell tale signs of illegal apartments... is your electric and cable "included" in the rent... in other words, no utilities in your name? do you have your own address or is it a shared mailbox? Does the landlord ask you to tell people you're related? stuff like that.

Still, as mentioned above... those are the ways to really check.

Thank you for all the replies. I called the town’s Building Department and was told that I had to file a Freedom of Information Act Application in order to find out whether the house has a permit for an apartment. However, I checked the “MyNassauProperty” Web site which showed that the house is a 2-family dwelling with 2 living units so I hope that is adequate evidence that it is a legal apartment.

Cable TV, phone, and Internet are not included in the rent, but the other utilities are.

The inclusion of utilites does not necessarily mean that an apartment is illegal.

Mine says the same thing and like I said I wouldn't take it as 100% accurate but it's better than it saying 1 family dwelling.
