Codes and zoning chAnge...if you can prove that the wall was there in the 70's then the 70's rules apply. You can FOIL information on your property...most of the older building and survey information was transferred to microfiche. If you met with planning and environment They prob. Told you to go down to the building department as they keep the older information on film. Bring some money, They charge per page if you find something you want a copy of.

The wall that fell is over 6 feet tall - but since it was built WITHOUT a permit will the town have any proof of it? I am searchingfor my survey that we used at closing (in 2003) but that won't help me too much as my lawyer SHOULD HAVE caught it and questioned it THEN.

A few people have advised me that I DON'T need a lawyer - my engineer just suggested contacting my old lawyer to see what he had to say....

I will go down to town hall tomorrow for the FOIL stuff....they have been very nice through this whole thing....
