Hello Everybody,
My mother is currently in a similar situation with the "eviction" process in Suffolk County. My mother subletted without the knowledge and permission of the landlord as a favor for a friend. A woman and her children were "homeless" at the time and needed somewhere to stay. She said she would pay my mother $500 a month for a bedroom in the basement. We are currently in the eviction process, but my mother is in the wrong, because a) she allowed this woman to enter into our house without permission from the landlord in direct violation of our lease, b) the room she rented is not legal in any manner and in an illegal basement. We are at an extreme disadvantage because we are not the landlords, but the lease holders. This woman also hasn't paid her rent since july and now she is threatening to call the town on my mother for the illegal apartment, it is evident that she is a habitual tenant that requires eviction to leave the premises, she knows the system and is exploiting it. What should we do? Our landlord wants no involvement in the situation;which is understandable; and says that we got her in so we have to get her out. It was supposed to be temporary and a favor for a friend and has already become a financial burden...any advice would help! Thank you!

Call town, start eviction process.

Or call in a few friends to rent the basement with her and make life hell.

Thanks Silverbullet, we already filed the eviction papers and have a court date settled, unfortunately we can't afford a lawyer, so we have to represent ourselves in court. We would rather not bother her because she is ghetto and trashy, we already have a file with the local police department due to her behavior; noise complaints, property damage, threatening family members, etc. We just want her out and unfortunately for us she already has judgments against her for previous evictions, so she knows the system well. Ahhh...when attempting to do a good deed goes wrong! My mother is taking it really hard, she has "no faith" in humanity any longer...blah!

If shes threatening then just file a restraining order. She can't come on the property.

Ghetto and trashy eh? Why was she let in in the first place...

Question: Would the town begin the process even though she is not the home owner? I cant see this getting any better until it gets worse. I do agree with silverbullet however...get some big 6' 2" friends to become her new roomies...see how long that lasts.

That will indeed work.

Depending on the situation and how it's handled, it can take some time, though. Might, might not. Also, she will be allowed to come onto the property with a police escort for 5 minutes to get her things.

If it were this easy every home owner looking to get rid of a non rent paying piece of garbage would do it at the same time as starting the eviction process. A restraining order for the verbal stuff will not be easy to get and a restraining order can be given without having the person leave the premises.

In my opinion, the landlord should start eviction proceedings against both parties. The woman should have never rented a room that she has no authority to rent. I can't see a judge getting this case being very sympathetic towards the person who rented out a room without the authority to do so. Other trouble can come from that as well; illegal renting, taxes, etc. Definitely not a good position to be in.

Default suffolk Eviction

my tenant told me she gets $1000/each kid from DSS every month because she is on disability payment by DSS or SSI. She has 4 kids. So why her kids didn’t go to school every time when my husband and I went there. Sometime we only see the 12 years old boy left alone at home, both their parents are not home(because we tried to collect rent every month since they move in, we drove there 2 or 3 time at beginning of the month). Their kids age are 15, 12,10 and 8. Also on 11/18/2010 when the police went there, my husband saw her kid stay at home, include yesterday when Health Department went there too. I believe the DSS should investigate the kids get proper education if DSS pays for their parents. They deserve a reliable parents to get them a stable life and a proper education which I have been paying $5,720/ year property tax to support the school in Wyandanch School district.

weina my tenant use my residential property for commercial use, he has a big truck body at the back yard, I took photos and sent to Suffolk County Excursive Steve Levy and other official email address. I got his reply within 24 hours. They are investigating the issue Since 11/23/2010. my tenant has been complain to town of Babylon Judith, Fire Marshall Anthony. Health Department Mrs. Cananvan,and DSS about the house without heat. my husband went to the house. He won't let my husband in, and curse my husband:" get off my property, you mother F. I grow up in wyandanch, I know the system better than you do, you mother F" for 15 minutes. My husband called police, we couldn't gain access to the house.

Default Suffolk Eviction-second district court lindenhurst

we faxed the police report to Health department, health department told them they have to let us in to check the furnace. so my husband met with health department and finally get in the house to fixed it. they haven't pay their rent since Oct 1. I redid the whole house cost $30.000 in May 2010. and pass the town plumbing, gas, electrical inspection and rental inspection in May, the whole house is new. I got a lawyer now to try to evict them. which you have to give to DSS and tenant 30 days notice. my court date will be January 2011.
It is very big headache. my husband told me to sell the house (88 parkway blvd. Wyandanch).
