We are looking at a house in melville that backs a 30 foot wide easement that runs through entire street's backyards. Does anyone know how far from this you can put fence? Also, the house is on a corner-does anyone know how far from curb you can run fence? Thanks.

It depends entirely on what the Town's zoning laws are. Melville is in the Town of Huntington; you would have to call the Town of Huntington's Zoning or Planning Board and ask them.

(edit): The Town's website listing their departments is here; it looks like "Planning and Environment" is who you probably need to get in touch with.

Town of Huntington

Find the zoning out for the property using the above link. Then call either the planning or building department with the zoning info, Section, lot & block number and ask about the fence/easement issue.

Also -- you might want to learn what this easement is for if there's nothing going on there now.

I believe in Huntington it's 5 feet from the property line. Check with them, just in case. At town hall it depends on who you get and what side of the bed they got out on this morning.

Sounds like Brookhaven -- and the side of the bed is usually the same as the answer: wrong!

thanks-i called some of the numbers the website listed and was told fence could be up to/but not touching easement and fence on corner side needs to be 25 feet from both roads-that would leave me with almost nothing to fence on that side. I thought is sounded like a lot but they said b/c of ubstruction issues.

25 Feet doesn't sound right. Is it a high fence that you are planning to put in?

Tom-no plans for fence yet only very interested in house. We are trying to see how much of the land is usable and private-the house since on an acre but much of it is on the sides and we have young kids.

Maybe you should go back to the town and ask about different options. Since they raised the "obstruction" issue, maybe a lower fence or a chain link might be permitted closer to the property line.

thanks tom-we are going to try to get the land survey from the owners and then go to the town. If there is no land on the other side that is usable, then we won't bother going further with the house-the easement side (52 ft not 30) is where more of the land is. If that lands is enough for us we will look into a iron gate type fence for the corner side.
