If you check the Penal Law there are no statutes that have to do with removing illegal aliens. That has to be handled by the feds. ICE isn't exactly patrolling the streets.
There was a MS13 gang member in court the other day that was being held for deportation for the fourth time, meaning he has been expelled three times already and then returned to the country illegally anyway. Apparently his three prior deportations were all due to gun possession!
The bottom line is, until we pass new federal laws regarding illegal aliens and their status in their country, nothing will be done about the problem. While nothing is being done, they are out-breeding us probably 4 to 1. Welcome to the new America.

This is true, local police have no authority to enforce the INA, the best they can do is arrest them for a local crime, to which they will be identified by ICE either in the jail or fingerprinting via the "secure communities" program. Even then ICE may not take custody. It all depends on many factors, criminal history etc.
Several things need to be understood here. Arresting an alien and placing them in removal proceedings is only half the battle. They then are entitled to have an immigration hearing before a judge which can go on for months and in some cases years. Many arrested aliens are also granted bail and simply never show up for court. The system is a mess, and its all in the alien's favor.
Also if this Amnesty bill that is being ram-rodded through congress passes, all these illegals you see on the streets will get visas and will no longer be illegal. Unless they commit a major crime there will be nothing ICE can do deportation wise.
And yes many deportees return. If they have a felony on record and return they can be prosecuted federally for re-entry and will serve prison time before being deported again. Most however are simply just "re-instated" and kicked out of the country again.
Bottom line, there is plenty of blame to go around, from local politicians who refuse to enforce safe housing codes (ie 20 people in a 1 family home), to the federal gov't who doesn't want to enforce the law (democrats want easy votes, republicans want cheap labor). The whole system is completely broken.
