I live in Plainview (Town of Oyster Bay). Around my home it seems each house has put up a fence (some wood, some PVC) on at least one side of their property facing another's property. Is there a law that applies to determine who is responsible for a fence between them. My property facing 1 neighbor has an old fence put up by the original neighbor/owner like 50 years ago. Since then the property has been sold and old house raised. The old fence is falling apart. The new owner who is building on the property, will be removing this old fence. He claims he does not need to replace it and does not plan to have a fence between us. My Q. is if there are any regulations about requiring a neighbor to put up a fence? Thanks.
It is his fence and unless city code requires a fence be put up for a pool, sauna, jacuzzi etc. your neighbor is not required to replace the fence. If it is that important for you to have a fence between your property and the neighbor's property, put one up yourself.
