It is his fence and unless city code requires a fence be put up for a pool, sauna, jacuzzi etc. your neighbor is not required to replace the fence. If it is that important for you to have a fence between your property and the neighbor's property, put one up yourself.

Why would your neighbor be forced to pay for something you want and he doesn't?

Is this poster related to the guy who wanted to call 911 because his neighbor was draining rain water off his pool cover and making the street wet????

Guys, I want my neighbor to be jealous of my large television. The problem is, the one I have is too small. Can I make them buy me a TV so I can rub it in their faces?

Where you live now, the neighbors would only be jealous if you have a bigger peeekup truck or more mounted taxidermy then they have.
