This is wrong. Yes, they can say they are giving a discount for cash, BUT must advertise the higher price and then offer a discount for cash. So if a gas station charges 3.59 for cash but 4.59 for credit then by law they are supposed to advertise the higher price and offer a discount for cash . By posting the lower price and charging extra for using a credit card, then that is illegal.
So yes, they can claim they are offering a discount for cash, but must advertise the higher price from which they are offering the discount.
This "loophole" is still going through the court system.
Some weasel lawyer thought this one up ("It's a cash discount; not a credit card surcharge!") for sure!
