The appeal process is a small claims action proceeding (SCARP) that needs to be filed with Suffolk County Clerk's office. You have 30 days to file the appeal from the date of the final assessment roll. Please feel free to call or email me with any questions. Good luck!

I got the discount on the purchase price of home instead of comparable. I also used aventine properties. They were professional and informative. They automatically went to court even though I spoke to Gregory Hildt the town assessor of smithtown. he told me that "I would've adjusted your taxes in the office. No waiting" I don't believe that for a sec. He is has his own agenda. I would have only got a fair assessment through the court. That's it. Yes it'll cost you but you'll have peace of mind.

That's right, this past spring I refinanced and got an appraisal that I THOUGHT I could use to file a grievance, but they look at the value from July of the previous year (so I was denied). I would have needed an appraisal from 7/08. I believe I can use my appraisalv (from this past spring) to grieve (next May).
Too bad this info isn't readily available.

An estimate of your property value is available at grieveyourtaxes. Towns do not use properties sold in foreclosures, short sales or other sales that are not considered "arms length" transactions because they do not represent the true value of the property. Only normal transactions (arms length) using the normal channels for the sale of real estate are considered. Your towns assessor should have supported your petition with your contract and appraisal.

Yes, there is an appraisal fee but we won the first time around which was well worth the appraisal fee. If we had lost they wouldn't have charged us a cent. You get what you pay for

The maximum reduction is 25% only if the assessed value exceeds 450,000. If it is less than $450,000, there is no limit.

There is a 1 year wait but that is only if you are successful on appeal. If you are successful at the Board level, you may file again the next year. If you get denied at the appeal stage, you can grieve again the next year as well.

I think they deleted my post because I put the URL in. So for those of you that e-mailed me about the name of the service I used its Long island Tax Cut. They are located on Main street in Smithtown.

I guess that explains why I was told the max reduction is 25% - my assessed value exceeds $450K...

When you grieved your taxes in May 2009 the valuation date is July 1, 2008. When you grieve your taxes in May 2010, the valuation date is July 1, 2009.
