The points on license are the biggest thing. Money is whatever but i cannot have points & i shouldnt be given them bc I did nothing wrong...

Whats the chance of getting it dismissed or at least getting lowered so i dont get points.

Just as much as I have no proof I am right the cop has no proof either

I have no idea how this process works

This is the exact definition....

1172. Stop signs and yield signs. (a) Except when directed to
proceed by a police officer, every driver of a vehicle approaching a
stop sign shall stop at a clearly marked stop line, but if none, then
shall stop before entering the crosswalk on the near side of the
intersection, or in the event there is no crosswalk, at the point
nearest the intersecting roadway where the driver has a view of the
approaching traffic on the intersecting roadway before entering the
intersection and the right to proceed shall be subject to the provisions
of section eleven hundred forty-two.

(b) The driver of a vehicle approaching a yield sign if required for
safety to stop shall stop at a clearly marked yield line, but if none,
then shall stop before entering the crosswalk on the near side of the
intersection, or in the event there is no crosswalk, at the point
nearest the intersecting roadway where the driver has a view of the
approaching traffic on the intersecting roadway before entering the

there's tons of cameras around. If you're so sure you didn't do anything, go back and see if there are any cameras to buttress your case...

I also agree it’s time for a dash cam. There’s a reason everyone driving in Russia has one...corruption.

I would get a lawyer involved. At the very least it improves your chances of getting it reduced to a non-moving violation. Make sure you mention it was not only a full stop but that you could feel the weight shifting in the car.

What will happen at court? Never went to court before other than for jury duty

How would i get access to camera footage if there is one?

The cops word is his proof, otherwise why would they bother giving out tickets at all? Anyone can show up to court and say "I didn't do it", if that happened and they let everyone off based on their say-so, the whole money making system would grind to a halt. I'm guessing you are in your mid-30s based on your username, does this really need to be explained?

As someone said unless you can show up with a surveillance camera from the area showing what happened, plead it down to a non moving violation, pay your money (ALL THEY CARE ABOUT) and move on with your life.

PS Good luck getting camera footage, most companies won't release it.

I'm shocked no one has inquired Nassau or Suffolk yet.

If it's Nassau- just go to court. They seem to reduce everything- since a small portion of tickets are a total scam.

You mean to tell me you came to a complete stop and a cop decided just to pick you for a ticket?
Very few people make a full stop at a stop sign unless there is traffic. There are a lot of four way stop signs in my neighborhood and many drivers don't even make a rolling stop. They slow to 10-15 mph and go right through them. They probably think they are obeying the sign because they slowed down.

How long did you stop at the sign? Rule of thumb is 3 seconds.

the chances of a reduction are good in long island .

but don't forget points are not seen by an insurer. that is only used internally by dmv as far as suspending your license .

insurers go by convictions and use their own scoring system . so while a seat belt ticket has no dmv points your insurer may count it heavily against you in their scoring model

I donít think thereís a required amount of time, but if you feel the weight shift in the vehicle you know it has come to a complete stop. The problem is the momentary stop.
