I think the thing you all are missing here is the fact that it is his property, "Constitutionaly " you say it's an eyesore! What doctor did you go to for that injury?? What treatment did he/she prescribe for you ?? and will you recover ? I think you will as soon as you understand the neighbor has rights too! and some of those are to keep his personal property on "HIS PRORERTY".. Why don't you offer to buy his property ? then you could control it like you are trying to do now!

Just because it's his property does not mean he can do with it things that will negatively impact his neighbors. We have to maintain some standards otherwise every area would look like a dump.

Your neighbor is partially right. She may be a cranky budinsky, but if she ever did call the town, you might have problems. I can only guess that if the code doesn't allow for commercial vehicles to be parked on the property, they aren't going to allow commercial vehicles to be parked on the property overnight. Also, the town does consider livery plates to be commercial. Perhaps the reasoning is that the livery driver is engaging in business?
The law is different in Brookhaven. They will allow a commercial vehicle on one's property as long as the GVW is under 10,000 lbs if I recall correctly.
Town of Oyster Bay code Chapter 246 - Zoning, SS 8.2.6:
8.2.6 Off -street parking in residence districts. Other than as specified elsewhere in this chapter, off street parkingin residence districts shall be permitted only for private passenger vehicles, currently registered and in active use, and only on paved surfaces. Such parkingmay only be located within: (a) a side or rear yard so long as such spaces are located outside of the minimum required side yard or rear yard; (b) that portion of the required front yard immediately contiguous to the extension of either required side yard; (c) that portion of the required front yard immediately contiguous to and an extension of a garage which is integral with the residence structure and has its entrance door within the front wall thereof; or (d) in front of a building but beyond the minimum required front yard in the case of circular driveways with two curb cuts. [Amended 7-22-2003 by L.L. No. 7-2003; 4-25-2006 by L.L. No. 5-2006]
Also, the Town of Oyster Bay considers the following commercial Chapter 246 SS 2:
COMMERCIAL VEHICLE -- A vehicle bearing a commercial , livery or taxi plate. [Added 1-18-2005 by L.L. No. 1-2005]
|
I know theres no commercial parking overnight in massapequa but I never was able to verify the no commercial parking in one's own driveway. I mean, where is one to park thier commercial vehicle then? we had 3 (my father's limo and our 2 construction vans).

All I did was ask a simple question, present my thoughts carefully and politely -- and it comes to this. To the few of you who actually understood this, I thank you. To the rest of you, thanks for nothing. Well, nothing but abuse, anyway.
You can bet I won't be back here. Bye.

We had neighbors years ago who kept not one, but two non-running jalopies in their front yard right across the street from us. A very small front yard. It looked like a dump. The husband explained that he used wires and things from one car to fix the clothes dryer and other appliances around his house. Not sure what the other non-running car was for. Have to say that after a while it starts to feel like you're living in a very rundown side of town, even thougn it wasn't.
The last straw came when he moved one of the "cars" to the road; it had no plates, etc. And one day after a snow/ice storm I ended up backing out of our driveway to go to work in the early AM and almost crashed into it (a very narrow road) because of the ice - couldn't stop. That's when I called the code compliance office and reported it. This was after about 2 years of looking at these eyesores.
It all depends on your sense of aesthetics and how short or long a fuse you have. And if the eyesore poses a problem - such as danger to kids, etc. Some neighborhoods/towns have ordinances against keeping boats in yards because they want things to look a certain way - well kept for instance. The boat person ought to live where boats in yards are allowed.
I don't think it's unreasonable for a neighbor to not want to look at someone's eyesore every day for years on end. Plus when it's time for them to sell their house (the neighbor doing the looking) potential buyers probably wouldn't want to look at some guy's boat all the time. It will chase away a sale.
