I have a neighbor who operates a business right on the sidewalk in front of his house pretty much all summer long, with the exception of the days where the temperature dips below 65 or it rains. This has been the second year he's been working right out on the street.
He also yells at passing cars trying to solicit business from time to time -- and sometimes his "friends" join in -- and I was wondering about the legality of that, too.
At the risk of sounding like a snob, the sight of this enterprise is beginning to get to me, to say the least. It seems to have become a semi-permanent fixture on an otherwise nice piece of property. It really does seem to cheapen the look of the neighborhood. I've tried to bring up the subject of the lemonade stand to him, but I find it difficult to argue with an 8 year old, and also he's tried to bribe me, knowing I get thirsty like everyone else.
Are there any laws against this sort of thing in Levittown, or in the Town of Hempstead in general?
Although it is probably annoying, an 8 yr old's lemonade stand probably doesn't qualify as a business. I don't know if you have any legal recourse and I'm not sure if you really should go after an 8 yr old???? (although I'm sure if you contact the Town of Hempstead, you can get an answer)
Also, is any money from the stand going to charity? It could be a nice fundraiser if it was. If not, maybe you want to suggest it to the 8 yr old (or talk to his parents)

Have every neighbor around him open a lemonade stand too, and always discount based on his price. Also switch out his sugar supplies with salt. When he goes out of business, squirt lemon juice in his eye and tell him, that's capitalism for you, hows it taste.

That's it. Call the cops and have him arrested. This way, he'll have a record. Now sue him and take him to court. Since he's 8, he won't be able to afford an attorney so they'll give him a court appointed one. You on the other hand should get a top notch lawyer that will make this kid cry on the witness stand and go to jail for 20 years for his crime.
He's just a kid just trying to earn some money. What is wrong with that? That does not cheapen the neighborhood. Suppose an ugly person moved into your neighborhood and started mowing his own lawn. Are you going to call the authorities on him because his ugliness cheapens your neighborhood. If everyone has a white car on your block and someone buys a black car, does that cheapen your neighborhood?
Let the kid enjoy his lemonade/iced tea stand. Most of us here have probably done that when we were kids. Nobody bothered us and we bothered nobody.
If he and his friends are running in the street in front of cars, then you have a legit complaint, but only to complain to his parents. If they just yell at passing cars to come buy something and not jumping in front of cars, then that should be just fine. I doubt they make more noise than your lawnmower or your landscaper's mowers.
I dunno. Eight year olds can be pretty shady. Sounds like a criminal enterprise to me. What ELSE is he selling besides lemonade is what I want to know.
