Hi all, new to this forum, seems like a good resource, been lurking for a few days checking it out...

Anyway, our 4 br/2ba house is up for sale and the listing agent originally listed as 2 bath. A visit to Huntington town hall revealed there are no COs for the finished basement or 2nd bath which is in basement. Our agent has changed listing to 1 bath, which I believe really limits the amount of buyers.
Do below grade baths count as baths in a listing? or is that not appropriate for some reason?
I understand maybe not listing it until the CO process is started (which is happening ASAP) but is there a reason not to include it in listing afterwards that I'm not aware of?

In my opinion, it should be listed as a 2 bath and you should begin the process of getting the CO so that you have it in time for closing.

Thanks for the reply. Is listing it as a 2 bath with no CO perhaps a false representation issue the agent is afraid of? I'm just trying to understand the reasoning. I am going to bring it up again with them. And start the drawings and pics for the CO.

Any tips/advice on CO process (built w/o permit) in Huntington?
The finished basement has a door into the garage, any idea if this meets egress requirements? I would think it should.

Egress requirements? Is this simply a finished basement for single family use or an accessory apartment? Why would there be egress requirements for a finished basement in a house that is a single family? Because there's a bathroom and in case of emergency someone sitting on the toilet should have another exit? If it is an apartment, then the listing agent is correct in listing 1 bath, as the 1 bath is what is available in the main part of the home. If you want the 2nd bath mentioned in the listing, you could have your agent put in the text "2nd bath w/CO pending" (if it is simply a finished basement) or "accessory apt. w/CO pending" (if it is actually an apartment).

It's good you are at least starting the CO process. Too many homeowners modify their houses and don't bother with them and put them up for sale that way and expect the potential buyers to wade through it all.

no apartment, just finished. I'm new to all this CO stuff and requirements, maybe just bedrooms require egress? I have no idea.. Guess we should have checked site history report when we bought the house, live and learn.

If there is a bedroom eggress is definately required, regardless of whether its an apartment. I don't know about general finishing of a basement.

I'm not familiar with the codes around here, but I know in some other states, you need an egress window if the basement will have habitable finished rooms, in addition to each bedroom requiring one.

Best bet is to check with the Town you're in, since each Town has their own set of building codes.

As for the bathroom, I'm with Tom on this one - list it, you're getting the CO anyway.
