Elke Mariotti -- I agree with you on that, that commission is still due if the property was shown during the listing period. However, they saw the property after it expired.

The OP really needs to take some time in educating him/herself about agency relationships and what should be reasonably expected of Realtor.

Please note that Standard of Practice 3-4 and Standard of Practice 16-16 are not enforcable in New York as they contrevene NYS Law.

(Although it may not matter except to real estate rules geeks like me)

how is a buyer sure that the "buyer" agent is working 100% for them? the fact is the higher the sell price the more they get... even as a buyers agent.

This is a suspicion that many buyers have. However, for most agents, a $10000 price difference only amounts to about $100 increase in what goes in their pocket, so there is not a huge incentive to get a higher price for the seller.

No we never signed any contract. I had no idea that it works like this! Wow, thanks for letting me know! This new agent that I just started seeing houses with (first time was this past weekend) - didn't tell me anything about this too. Do you think I should ask her to give me the contract? If we do have a contract and she officially becomes a buyer's agent - what are the terms of her comission? thanks in advance!

What I don't see is where you went back to your original Realtor with the allegations of the 'Seller. Seems like he's set a price and will say whatever to get it. You're trashing someones reputation without affording them the opportunity to defend themselves. - NOT a good thing!

If the agent did not give you a disclosure before showing you homes, I would not consider hiring her as a buyer's agent. She either is ignorant of the most basic laws governing the practice of real estate or she is ignoring them. Commission terms are negotiable.
