Hello, my landlord illegally deducted extra days rent beyond my move-out day from my security deposit. I've tried to reach her but she's avoiding my calls. Although I need the money to use, I'm afraid if I cash the check now, does that mean that I'm agreeing to her terms... Should I wait to cash the check in case I need to take her to small claims? Thanks for any advice.

Cashing that check is as good as writing her a letter saying you agree with what she did.
DON'T CASH IT.

Here's the info I found, which would come in handy for other renters in fighting unethical landlords trying to steal security deposit monies...

"The bottom line is, if the memo line on the front or the back of the check says anything like "full payment for lease" or "final settlement," or if there was a letter with the check that said anything like that, don't cash the check.. If the check doesn't say anything on the front or back and there's no other "offer," then you can endorse it and cash it and still go to Small Claims court."

Does cashing the security deposit refund check mean that you accept the amount that was returned? - Avvo.com

Default Deadline to cash check

I was sent a "settlement in full" security deposit refund. There are things to sort out. Is there a deadline for me to respond to landlord? And, is there a deadline to cash the check?
