My ex-husband is getting evicted from a 2 bedroom house and moving into his girlfriends 1 bedroom. We have 3 children together and he has custody of them on the weekends. Am I in my legal right to refuse him visitation b/c of the limited amount of space they will be providing when the children stay until they get a larger unit with space enough for the children?

Well, I believe the general rule is 2 per bedroom + 1, but I have no idea if that is law or where that is law. What you should probably do is contact the city housing authority where he will live to ask what, if any, occupancy laws there are, or directly contact your lawyer.

As far as the family court is concerned, and rightfully so, probably not. Ever hear of sleeping bags, sofas, fold-outs, air mattresses, etc.?

They're not taking up residence. They're visiting. Occupancy rules don't count!

Are you looking for excuses to deny him access to his children?

I totally agree with Curmudgeon, I don't think you have any rights, legal or otherwise. We are not talking about them living with him, we are taling about weekend visitation. heck, they might all enjoy sleeping on the floor and pretending they are camping out.

I think it is wonderful he wants to spend time with his kids. Many dads could care less.
