My husband earned a pay raise according to guidelines to reach a sales goal set by his employer at the end of last year. He was the only one in his department to reach it. When his employer found out he reached the goal, he retro actively changed the records & guidelines. When my husband complained, his employer gave him the raise over a month late & ever since has found ways to keep him from getting it on his check. His employer sent him an email instead of calling him on the phone or walking to his office stating he needed to see him asap. When my husband didn't see the email, he was suspended for 5 days without pay for not responding asap. My husband put in for vacation to travel out of state for our son's wedding in March & went thru the proper channels. The employer refused to give him all his vacation & the majority of what he did pay him was at last year's wages because he said he said it was vacation left over from last year. This continued for 2 paychecks. My husband has not received one check with the total raise. Now his current paycheck has a 28% pay cut with no reason. I believe this is retaliation for the raise. Also...my husband is one of three older employees who have recently been replaced by younger employees. Does he have any recourse?

Well the vacation part and last years salary sucks, but I am guessing (though I never have heard of anything like that) it might be legal, crappy, but legal. You say he has been replaced by younger employees, what do you mean? Do you mean he lost his job or what? Obviously unless that is the case, an employer has every right to hire who they want.

The not responding when sent an email, I would fight that one big time and the rest looks like a royal screwing. The 28% cut, there must be some explanation. The only problem you might have if you were to fight, what sounds like a legit fight, would be the loss of his job eventually and/or diffuculty finding something else in his field. Today many things are kept on computers. We had a bad experience (a little different, but bad) because of something kept on a computer and visable to others.

What you do about this is up to you. It sure sounds like you have grounds to take some action. Will you come out ahead, who knows? My brother in Ca and his wife are going through a discrimintion case with her old employer right now. It isn't turning out the way they had hoped.
