hey y'all,
a rent control tenant changed the locks on the unit and refused to give lessor a copy of keys. tenant served with a 3 day notice. 1) what's the latest time on day 3 tenant may turn in keys? 2) if tenant puts keys into lessor's mailbox after day 3, what should lessor do? thank you for your consideration. |

What did tennent do to deserve a 3 day notice? Landlords dont generally evict someone over a lock, they had to have done/or not done something to lead the landlord to serve them.
As far as leaving key, whether it was day 1, or day 3, or day 20, it doesnt matter anyway because by law, landlords are supposed to change the locks. They dont always do so, but not many areas enforce that law and if he needs to get in after the 3 days, he will get in, key or not. |

I think the landlord is entitled to the keys to the property. If law enforcement needed to get inside, if there were a water leak coming out of the apartment and no one is home, if you were to die and your relatives needed to get inside your place...
My guess would be he/she probably won't do anything... they just want the keys. I would suggest giving it to them because they just might be able to evict you for that. Though, I'm not sure. |

It sounds like they got a "3-Day to Perform or Quit". If you're behind in rent, you receive a "3-Day Notice to Pay or Quit". All rental agreements state that if a tenant changes their locks, they must provide a key to managment. Mommabear2 was correct. We need access for emergency purposes. What happens if you lock yourself out. You go to your manager and they'll let you in. That's alot easier than spending $50 for a lock smith.
If it was indeed a "Perform or Quit", they can start eviction after the 3 days has expired. Give them the key. Reputable managers/landlords/management companies are highly educated and know the laws - they will not enter without a proper 24 hour notice - and there has to be a valid reason for that. We respect your privacy. |

does anyone know what time on day 3 is the terminal time to turn in the keys? is it considered working hours-- 8-5pm? and do any of you have knowledge or suggestions as to what to do if tenant puts keys into owner's mailbox after day 3? lahd said that owners have the right to keys to their units. two weeks ago, there was an emergency. water poured from this tenant's unit into the one below, flooding the lower unit. owner knocked on door but no one answered although tenant was home. 6 hours later tenant emerged and complained about owner knocking on door. note that owner did not bang on door but knocked. this is just one example of many in which tenant disturbs the lives of other tenants without remorse. not providing reasonable access is one of the 12 reasons a tenant may be evicted from a rent control unit. |
