Hey guys!

Is it legal to grow marijuana in California?

I've read that it was legal to grow up to 6 types of Marijuana under California Law, if you had a medical marijuana card, but it's still illegal to grow them under the Federal Law, which should make it illegal...? Right?

The reason I ask is because there's a tenant growing Marijuana by his window. The window is always open and it's grown pretty big, but seems like the manager hasn't said a word considering how long it's been there. I know of a few tenants that have complained of the smell of Marijuana bothering them, but nothings been done.

It's not hidden anywhere, it's literally out in the open. The tenants room is on the roof and the manager goes up the roof from time to time to make repairs and there's no way he can miss it.
*I've attached a picture that I took if anyone wants to see it.*

Shouldn't he have them kicked out or something?

Is there anything we, the tenants and parents, can do to solve this issue? Solve as in have the marijuana removed completely.

Thanks in advance!

"California State Senate Bill 420 authorizes card-holding medical marijuana users to possess up to six (6) mature plants, twelve (12) immature plants, and eight ounces (8 oz.) of dried cannabis. (Some counties allow more."

MJ laws can be pretty confusing sometimes and not totally black and white.

Kind of crazy they leave the window open like that all the time.

I would bring it up with the manager for sure if it's an issue. Did the tenants complain to the landlord or amongst themselves?

I'm pretty sure that tenants don't have a RIGHT to grow even if they might have the legal ability to do so.

There are likely a lot of landlords that might be "marijuana friendly"

It's an interesting issue for sure.

This is an article about a bill in Michigan that would allow landlords to ban Medical Marijuana smoking or growing on their property

Senate OKs Bill Letting Landlords Ban Medical Marijuana « CBS Detroit

It seems it could open up the landlord to different issues. How do they know they aren't growing more than they should? Do they even have a medical card? Are they selling it ? etc
