I have been renting my condo to the same tenant for the past 2 years.
I've never met them nor had any contact as I've used a property management company. The lease was up for renewal and the tenant had asked if they could go month to month because they were trying to purchase something. I asked the management company if the tenant would like to purchase my property but they came back saying they thought the hoas were too high. About 2 months later I got an email from the realty firm affiliated with the property management place saying the tenant had approached them about purchasing my condo. I will make nothing if the sale goes through the realtor. I will make a teeny bit if I sell it on my own...

Am I obligated to sell through the realty company affiliated with the property management firm? Can I contact the tenant and sell directly to them and have an attorney draw up the sale?

Since you never signed a listing agreement with the management company's realty arm, you don't owe them a commission. But make sure to get some kind of appraisal from an expert in your area to make sure you aren't getting short-changed. Advise from a real estate attorney is invaluable. good luck!

You dont know that for a fact; the home owner may have indeed signed a contract giving the RE broker rights to a listing within the management agreement. They need to re read their property management agreement before proceeding.
