Default Louisiana Road Home Struggle

It took 1 1/2 years for HGI to research Mom's tittle, (at least according to LRH). It took 2 years for Mom to get to closing. Now HGI has reported she colleced 4x what her check from the sale of her property to the IRS. I just love having to fight Metairie traffic to get to their office because as we all know they do not answer the phone. Sometimes I rue the day we applied for Road Home Assistance; it's not worth the stress and depression.

I wonder... When they eventually kill my Mom with all their screw ups by driving up her blood pressure, can I sue them for wrongful death?

Red tape. Typical government crap. I'm sorry you guys are going through that, and I do feel for you. You're just trying to get things going, and they have to make everything far more difficult than they really have to.

Thanks for the sympathy; I appreciate it. Just had to vent. I'm just waiting for Mom to get ready so that we can get HGI to fix the mess they made with the IRS. Apparently there are others who have done succession and are being over taxed for money not received so I'm gonna throw out what I've learned so far...

1. The IRS has no idea what to do. It only took an hour on the phone to learn they don't know, but the experience did have the benefit of really giving someone from the IRS a headache.

2. My CPA isn't sure about the usfruct thing and so to be on the safe side we should pay the taxes once HGI corrects the amount of money received. She is not sure about the usufruct thing. Bless her heart, we were only on the phone for 20 min., and she knew what she was talking about. Well, except for the usufruct thing.

3. According to the lawyer who did the succession the Louisiana Civil Code Article 616 provides that the usufruct gains all proceeds from the sale and so the LRH money should not have been credited to the children, (aka. naked owners), at all. This guy actually had me loving lawyers this morning. He looked up the code for me and sent it in an e-mail. Bless his little lawyer heart.

Just some FYI for anyone else in my shoes.

I'll echo SBCMetro, I'm really sorry that you're going through such sh*t. I have no idea what it must be like, but really feel for people having to deal with all this.

Thanks Jacq63. I thought because we finally closed with HGI the never ending red tape would be over, (ha). After fighting traffic from the Lower 9 all the way to Metairie, (basically the entire NO metro area), we discovered that the address on the envelope was at the mall. After calling for 2 days, HGI finally answered the phone when we were 10 min. away only to learn that the address was useless to us.

Oh well, we went to a restaurant to eat so all was not lost. I was told that they corrected the mistake during our phone conversation. Like anyone else here having dealt with the alphabet government agencies would say, "I'll believe it when I see it and not a moment before, and even after I've seen it I'm still skeptical."
