Hi, I am hoping that someone can possibly help me out as I really need to find out some answers ASAP. In July 2014, I moved in with a roommate in an apartment. My roommate has just recently moved from this apartment, and put in his 30 days notice already. Ok, so I have been an occupant on the lease since July of 2014. I am actually confused, and I really need to speak with the apartment office more but I really need to know what my rights are as an occupant on the lease. I do recall the apartment complex stating to me awhile back that both myself and my roommate are EQUALLY responsible for paying that rent so that leads me to believe that I am an equal on the lease, but I just am not sure. Also, I have made quite a few payments DIRECTLY to the apartment complex , along with sometimes paying my roommate for the rent. So this is a very confusing situation for me and I really do need to get some clarification. I also received a letter from the complex, addressed to (my former roommate) and residents..... This letter stated renew now and you can have the monthly rent of $615. It then said if you do not renew your lease for a year then it will convert to paying on a month to month basis for an additional fee BUT then I called the manager at the office here at the apartments and she said well you must reapply for a new lease and be approved or you have to be out my Nov 30th. So the issue is, I am not working right now so obviously I cannot prove that I make 2.5 to 3 times the rent. BUT what she told me and what I am reading on this letter are completely contradictory. Can anyone give me some advice on this? I really need to get this worked out. I have some money saved up to pay the rent but I dont know if I will be allowed to stay here without having proof of income and I have nowhere else to go whatsoever. Any advice that anyone can give me to help me in this matter would be truly and greatly appreciated. Thanks so much

The letter you received must have been generated prior to him putting in his notice to vacate since he was listed on it. A letter like that isn't binding. Since the complex stated that you were also responsible for the lease, then your lease with him is likely no longer valid since half of their qualifier for the existing lease is no longer there. You would either need to a) find another roommate who could help you cover the rent or b) start looking for a new place, because it sounds like you wouldn't be able to qualify otherwise.

You could try and talk to an attorney about it to see if there's some way around those things, but I'm pretty sure what the agent told you is correct.

Good luck. Maybe you'll be able to find a job in the next few weeks that would allow you to qualify.
