I'm pretty sure this would be a privacy violation and if taken to the supreme court, ultimately, would be disallowed. It just won't matter until it is used to prove something that otherwise wouldn't have a chance to stand on it's own...then it might cause some problems big enough to get to a higher court. I wonder how that judge would like to be tracked? Perhaps once their secret outtings were uncovered, they would want to rule a different way...it's much easier for people to judge when it doesn't apply to them (or they think it doesn't).
Now as far as the other "goofy" laws...I don't think they are all goofy! Here's my take, it might help you see a different POV...and I know Milwaukee City and I are on opposite sides of the spectrum...but it is nice to step over the fence and take a peek every now and then to grow personally, yes? :-D
***Ban Drive Thrus - well, Americans are obese and honestly, if you are going out to get fast food, chances are higher you are one of those heading towards obesity. It could be healthy for you to be forced to get out of your car to get your food...and savor (and save) some fresh air while you're at it!
***Would you rather have homeless people living in shelters you are paying for? Would you rather have them sleeping behind your house in an alley? Or illegally in a vacant house that then burns down from burning inside for heat? No, you would rather not have homeless people altogether, right? Well...then that should really be of more concern, how to stop homelessness and help fellow humans rather than how to avoid the inconvenience of having to see them. Even if they have lost their home, they ARE people...you can drive anywhere in your car and park it just as they can, it is shameful that people are only viewed as worthy of rights if they are "clean"
***Why is marijuana illegal? Why not just put limits on it and go on with life...there are so many other issues to worry about than someone consuming a plant...seriously.
***Idling the car in winter wouldn't be necessary if the city implemented a plan to provide engine heaters to everyone :-p if they are serious about that one, they really should be doing something to help people with their needs.
***Smoking ban...this is pretty important to me because smoking has been proven over and over again to be a killer, especially to people who don't have the filter to breathe through and no choice (2nd hand smoke). It is a basic human right to breathe....and I think it should be attempted murder if you force someone to inhale a known poison. There is no safe level of smoke and it is NOT necessary for anything, it is simply a wasteful choice (and selfish one). I always wonder if you want to kill yourself smoking, why smokers can't be less selfish and choose a way to committ suicide without killing everyone else in the process? Smokers are just bored or stressed people, they need healthier outlets that don't affect others' health (and the environment) so greatly.
***Opening the door is just common sense...if you don't check to see if it is safe, the world is less one more low IQ person LOL - seriously, how could this be a law, they would all be too dumb to read the law if they were too dumb to not check for traffic before stepping into it. Geesh. LOL this is humorous! :-D who thought to write this law and sponsor it??
***Liquor law...wow, this would be the first time I've seen an alcohol MINIMUM law, not maximum...I guess alcohol is a favorite pasttime there and big money for the state???
***Chickens...now I like this one...it would be great if you could have pet chickens to raise and be self-sufficient. They're a lot safer than pitbulls and cats jumping over fences and doing their thang in everyone else's gardens! Why don't you like this one? Is this a law already? I'd love to have chickens in the city! :-D
***affordable housing - yeah, this one actually throws me both ways...while it attempts to equalize all...it will ultimately keep housing prices from appreciating as much as they could. As an outsider, I was really disturbed to not be able to find a neighborhood without duplexes and apartments connected to it...I'm sure this helps the crime statistics though, and from what I can find, Madison really likes their #s....they are in denial even when there is a crime occuring from what I've read about those murders from last year. I disagree with this law...there have always been different villages in the world and some separation is okay...if there is no reason to "move up in the world" as far as housing, everyone would just stay where they are and lose motivation.
So there we go...I don't live in Madison yet...3 more weeks to go :-D
I don't know if I'll fit in with my strong viewpoints above...but...that's how someone 2000 miles outside of WI feels...so perhaps they aren't so wacky afterall...

Let's ad this to the list of Madison goofy laws and ordinances, I'm trying to think of all of them:
1. Ban Drive Thru's
2. Letting homeless people live in their cars and park wherever they wanted
3. Pot just a misdemeanor
4. Making it illegal to idle your car in your driveway in winter
5. Ban Smoking
6. to open the door of a parked or standing vehicle into traffic without checking to make sure it’s safe.
7. ban the sale of beer and malt liquor in amounts less than a six-pack of bottles, liquor in the amounts of 200 milliliters or less and the sale of fortified wine for consumption off the premises on which it was sold.
8. Oh you want chickens in your city backyard sure go ahead
9. Inclusionary zoning law- very new housing development contains some affordable housing. Madison became the first city in Wisconsin to pass such an ordinance.
Now that's progressive! now I admit I don't know if all of thee above have been passed or repealed but I know they were all at least proposed.
Is Madison smoking their own wacky tobacky or is it just the politicians or do people in Madison actually want all the laws or ordinances they pass?
