Hi,

I made a contract with Ryan homes on Wednesday. As per the contract I have 5 days to cancel the contrat. Yesterday, I went to Ryan homes office and the sales person was not there. I met another sales person and she told she can't do the paperwork to cancel the contract. Finally, after some calls to her co-workers she ask us to write a cancellation notice and we give them a hand-written cancellation and she give a letter saying "they received the cancellation request". She told it will take couple of days to cancel from their division and along with the cancellation paper we will recieve the deposit money. Also, she suggest to cancel the check through my bank. I already called my bank and put a hold on the check release. When we signed the contract the sales person told us, they won't deposit until the 5th day and we will receive it back immediately when we cancel the contrat.

My question,
Is it good enough to cancel the contract.
Is the hand-written cancellation is good enough?.
Is there any specific format for cancellation?

What you also need to do is call the Head quarter or main office in MAryland. If you go on their website their should be a number to call and ask to speak to the property manager or a supervisor and also fax over a cancellation letter to the supervisor. Incase the sales agent say they never receive the cancellation from you.

What you have already done should be sufficent. You have submitted in writing you request and you've gotten a letter stating that they formally have your cancellation request. Good call on canceling the check though, sometimes one hand does not know what the other is doing, so it's better to be ssafe than sorry. I am not a lawyer by any means, but I've never seen a situation like this where what you have done was not enough to cancel the contract and walk away from the deal.
