I live in a 2 unit apartment on the ground floor. I have access to the basement and I see that there is one 100 gallon water heater which provides hot water to both units. I have been through the upstairs unit several times and there is no hot water heater in that unit. After looking further, I realized that the one water heater is wired into my circuit breaker panel which is resulting in the fact that when the upstairs unit uses hot water this causes the heater to go on and I'm having it charged to me because of my electric meter is in use. Is this allowable?

I'm not sure if it's "allowed". Like you we have one hot water heater and I pay for it. However somehow the upstairs pays for my heat which is gas. They don't have anything gas up there (stove, heat, dryer etc.)
I know when the hot water heater broke two months ago they called the company because they had a warranty on it. I heard them ask them if there was two water heaters since it was a two unit building. They asked that pictures be taken to prove that there was indeed two to honor the warranty.

Well they couldn't provide that proof so they had to buy another.
