Default Au Pair question

I've heard people claim that it is illegal to hire an Au Pair directly, privately, without using an agency in between. Can anyone confirm wether this is true or not?

Its not in the least illegal, what is illegal is not withholding SS taxes, etc and at the end of the year generating the appropriate w2 or 1099 or whatever, which then people figure there is too much paperwork, which an agency handles directly for you, and so many opt for that route as its easier - not because its the only legal way.
