Default real estate tax lein

Hi All, I lost my house in 2006 from forclosure . I lived in Massachusetts. The town says I still owe the property taxes even though I filed Chap 7 in 06 and the house was sold in2007 less than a year after I left. Wouldn't the buyer have to pay off all leins at the time of sale? And shouldn't the town of Billerice Ma. give me this info? Thanks for any advice anyone may have. Richie

Did your bankruptcy include your real estate taxes in the decision? I'd be surprised if it did, as normally, bankruptcies don't get you off the hook for taxes. And no, the new buyer is not responsible for liens on your property due to taxes that were owed when the house was in your possession. They are still your responsibility to repay, unless it was covered specifically in your bankruptcy. And yes, whatever town the house was in, they should be able to give you the information regarding how much you owe.

All real estate taxes should have been paid when the new buyer took title to the property. Do you have a copy of the HUD Settlement Statement from the closing?

The bank (the Seller) would have had to give the new buyer a clean title - they always pay the outstanding taxes before selling to the new buyer. The buyer's attorney would not have allowed the sale to move forward without this lien being paid off.

Above posts are incorrect - it has nothing to do with your filing bankruptcy - its all about the foreclosure and the subsequent sale. You don't have a HUD because you were neither the buyer or seller. I guarantee you that the taxes you owed were paid off by the foreclosing bank.

And, yes, Billerica should release this info. Why are you concerned about it...are they sending you bills?
