Should be. They have limited the scope of the lawsuit to a couple narrow issues that will test whether the putatively conservative justices really support federalism.

They actually probably have a decent case, although I doubt anything will actually happen. The interesting part is all these states take federal money...but yet want the federal government to get out on certain issues.

And folks in MA and other places are more than happy to trample on and forget about the 10th amendment when it doesn't play in their favor. However, when we're talking about this vocal minority of less than 10% of the population, no expense or political spin spared.

Agreed. Like you said, the big thing is as long as something plays in their favor.

I agree they should just let the people of the state vote on it, that is all. This is the kind of issue best left up to the people not the government to make the decision for us

Because Massachusetts always does the right thing. They were also the first to abolish the slavery laws and it was only for "10% of the population". Why should the percentage of the population matter if a group of people are treated differently than others? Bigotry and prejudice is wrong, PERIOD! Good for Massachusetts for doing the RIGHT thing no matter how unpopular it is with the bigots!

Massachusetts was not the first state to abolish slavery, Vermont was.
