adult/tenant curfew @ 10
Is it illegal for an apartment complex to have all residents in the house @10pm even if they r on their on balcony..

Disclaimer: I'm neither a lawyer nor law enforcement, this is simply my unprofessional opinion.
Since an apartment complex is private property, I would think they could pretty much set any rules they want - especially if those rules are disclosed in the lease agreement.....or, at least, aren't in violation of that agreement.

I also am not lawyer nor law enforcement. However, this issue has been discussed in various city data sites. It seems to be quite common.
The opinion is that a landlord cannot set a curfew for one age group. He cannot say that those under 18 have to be in their units by 10PM. That would violate fair housing laws. He can set a provision in a lease that requires ALL tenants to be off common areas by a certain time. That is, he can close pools, clubhouses, by a certain hour. He can also create a rule that does not permit loitering after a certain hour.
Loitering is hanging around. In that regard sitting on a balcony doing nothing can be considered to be loitering.
So, yes depending on how the lease is worded, the landlord can require tenants to be in their units after 10PM
