Default Flyer's Hand out Laws

Hi,

Can anyone help me? I have been looking for the laws about flyer distribution in FL. I need to know where can I (or cannot) hand out flyers in the state of Florida. I mean parking lots of malls, libraries, offices, etc.

First, a disclaimer, I am not an attorney nor am I involved in law enforcement so this is by no means any kind of legal advice. For actual legal advice, you should consult with an attorney.

From what I have been told, you should never hand out flyers where there are signs that say no trespassing and/or no soliciting. If you were to leave a flyer on a door, this would constitute a solicitation even if you do not knock on doors.

The parking lots usually have signs that say no trespassing and/or no soliciting. I think if they do not, they are fair game BUT there could be local ordinances, and it may not be required to have anything posted notifying you NOT to do so.

We have handed out flyers and only do so in neighborhoods that do not have any no trespass and no soliciting signs. In fact, if a home in such a neighborhood has a no soliciting on the door, we bypass that home along with homes with dogs.

Most home owners have been pleasant and we have never ran across someone that was not happy with us leaving flyers on doors.

Libraries will not allow you to leave flyers unless your a non-profit and it is some kind of a community service.

Most malls will have a no trespass and no soliciting signs.

I found this post and was interested if we can hand out flyers on the beach, if anyone could provide some useful information on that I would appreciate it.

I think the keyword to get more information would be soliciting but I come up with a lot of links on prostitution so it has been difficult to get information on this.

I tell you what, you put a flyer on my car or door and you will get a call. It won't be very nice. Littering the streets with this crap is morally wrong and should be illegal. I hate going to shopping centers and come out only to find that my car has been attacked by people who have no right to touch my vehicle. It is trespassing and people who do it are jerks.

You have the people who supposedly hand out the Homeless voice however most of the time they do not even have the paper. Who knows where the money goes. These people are a danger to traffic as well. Same with the soccer idiots who stand in the street with their hands out. These people shoud earn their money instead of relying on people to just give it to them. It teaches work ethic.

We have a huge litter problem with all of the fliers going around. How about going green and finding another way to advertise than littering the streets and vandalizing peoples cars and homes. You put a flyer on someones house door when they are out of town and you just advertised to the crooks that no one is home. If it isn't illegal it should be.
